TERMS AND CONDITIONS OF DESIGN SERVICES
Scope of Work
The scope of work for our design services will be outlined in a project proposal provided by our firm. This proposal will include the specific services to be provided, the timeline for completion, and the deliverables for the project.
Fees
Our design fees are based on the scope of work outlined in the project proposal. We reserve the right to charge a minimum design and/or detailing fee, depending on the project, as outlined below:
Minimum design fee: R 3,500.00 or 6 tons
Minimum detailing fee: R 2,500.00 or 7 tons
Minimum Machine design fee: TBA depending on the complexity and requirements.
This fee will be applied to all projects, regardless of the complexity or scope of the work. The fee will be invoiced to the client at the time of project commencement.
Structural Engineering
We are not registered structural engineers, and our designs are not considered to be a substitute for a structural engineer’s services. While our designs are checked and reviewed to ensure they meet relevant building codes and regulations, we do not provide structural engineering services.
For clients who require a structural engineering package, we offer an additional service that includes site visits and certification at an additional cost to the client. This service is provided by our partner structural engineers, who are licensed professionals with expertise in structural engineering.
Engineering Package
The engineering package includes:
Site visits to ensure compliance with building codes and regulations
Certification of our designs by a licensed structural engineer
Additional documentation and reports as required
The cost of the engineering package will be outlined in the project proposal and will be invoiced separately from the design fee.
Payment Terms
Payment terms are as follows:
A 60% deposit is required upon signing of the project proposal to secure the booking.
The remaining balance is due upon completion of the project, unless otherwise agreed upon in writing.
A late payment fee of 15% will be applied to outstanding balances after 30 days.
Project Changes
We understand that changes to the project scope may occur during the course of the project. If changes are requested, we will provide a written estimate of the additional costs and time required to complete the changes. The client must agree to the changes and pay any additional fees before we proceed.
Intellectual Property
All intellectual property rights, including but not limited to copyright, trademark, and patent rights, shall remain with Durable Designs. The client grants us permission to use their trademarks, logos, and other intellectual property in order to complete the project.
Confidentiality
We agree to maintain confidentiality regarding all information and materials provided by the client during the course of the project. We will not disclose any confidential information to any third party without the client’s prior written consent.
Termination
Either party may terminate this agreement upon 10 days’ written notice. In the event of termination from our side, we will refund any fees paid by the client. Should the client terminate the agreement, we will retain the full deposit paid by the client.
Upon termination, all designs and/or detailing work will remain our property and will not be handed over to the client. Once a project is handed over, it is considered completed.
Dispute Resolution
Any disputes arising out of or related to this agreement shall be resolved through internal mediation.
Entire Agreement
This agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements.
Client Responsibilities
The client is responsible for providing all necessary information and materials to complete the project, including but not limited to:
Project specifications and requirements
Any relevant building codes or regulations
Any necessary permits or approvals
By signing a project proposal or accepting our design services, you acknowledge that you have read, understand, and agree to be bound by these terms and conditions.
